- SHIPPING AND DELIVERY
The orders will be shipped from our warehouse withing 2-3 business days, and depending on the delivery partner, the same shall be delivered to the delivery address within 7-8 business days. We will do our best to ensure timely delivery of your order placed with us. Our delivery Services do not include the redirection or transfer of toy boxes if you change your address and fail to update it in your account. We do not guarantee the speed at which address information is updated. To ensure delivery to a new address, you must promptly inform us by emailing us at enlighten@khilonaykapitara.com.
- MISSING OR LOST TOY PART
The order delivered to you by us shall contain a list of items forming a part of your order. In case any item is missing from the list, you must immediately write to us on enlighten@khilonaykapitara.com along with a photo and details of the missing item. We will do our best to deliver the missing item to you. However, our ability to send you the missing item is subject to the following considerations: (a) the availability of the missing item; (b) the economic feasibility of delivering the missing item in light of various factors; (c) our reasonable discretion in light of the applicable circumstances.
At the time of returning the order, you shall recheck the list of items delivered to you. In case any item is missing from the list, you must immediately write to us on enlighten@khilonaykapitara.com along with a photo and details of the missing item. The cost of the missing item shall be adjusted against the refundable security deposit. However, if the retail price of the missing item is higher than the refundable security deposit, you shall bear the additional costs.
- DELAY IN RETURN OF TOYS/EXTENSION OF RENTAL PERIOD:
In case, there is delay in return of toys, you will be charged on the rate of per day per toy. You are eligible to request an extension for the rental period of a specific toy, up to a maximum of one cycle, which is equivalent to (4) four weeks. Subsequent extensions may be granted for one cycle. Upon the completion of the second cycle, the toy must be returned to us. Please write to us on enlighten@khilonaykapitara.com to request an extension for the rental period of a specific toy.
- WEAR AND TEAR OF TOYS
We will not charge a member for wear and tear due to the normal use of the toys. Normal wear and tear are defined for the purposes of our terms as minor scratches or impacts on the toys that you use during the agreed-upon rental period before returning them to us.
If the contents of the toy boxes are consistently returned damaged by you, we may, at our sole discretion, charge the retail value replacement cost for all items in the toy box that are returned damaged. The replacement fees will not be waived if a member purchases a similar or identical toy, and all damaged items must be returned to us so that our partner craftsmen can attempt to repair them safely for children.
- SAFETY INFORMATION AND DISCLAIMERS
The safety of children is one of our top priorities. As a parent, guardian, or other supervising adult using our Services, you have an important role to play in ensuring that children safely use and enjoy the toys or other products rented or purchased through our Services. When using or allowing a child to use toys, you agree to do the following (collectively, the “Safety Usage Policies“):
- Read and adhere to each toy box’s important safety and maintenance information.
- Review and comply with all product information, safety handling, and usage instructions provided with the toy.
- Inspect all parts of the toy before each use.
- Remove toys from their packaging before presenting them to children and do not allow children to use or play with packaging materials (including, but not limited to, plastic bags or packaging, which may pose a choking hazard).
- Observe the age warning for each toy, including, but not limited to, ensuring that small parts are not given to children to avoid the risk of serious injury and choking.
- Always supervise children when using toys. The toys shall be stored at a place where the minor cannot use or gain access to the toy in your absence.
- Exercise particular caution with small parts, cords, and strings to avoid the risk of strangulation or choking.
- Never use a toy if any part is cracked, broken, or missing, if there is a musty odor emanating from the product, or if there are signs of mold. Please contact us on enlighten@khilonaykapitara.com if a toy is damaged or a part is missing or lost.
- Exposure to weather conditions and water can weaken or damage wooden toys or those with wooden components. Do not leave toys outside for extended periods. Do not immerse toys in water.
We are not responsible, nor are we or the affiliated entities (as defined below) liable to you or any other person, and you hereby agree not to sue, accuse, or hold the affiliated entities of the company responsible for any injuries (including death), property damage, or any other cost, loss, or damage of any kind to you or others in any way resulting from non-compliance, negligence, and non-compliance with our safety policies and terms of use and handling of any toy. You expressly agree hereby that you assume all risks related to the use or handling of any toy rented or purchased on www.khilonaykapitara.com.
While we strive to source toys from reputable suppliers and include in our toy boxes only toys that we believe to be of high quality and safe for children in the specified age range, you further acknowledge and agree that:
- we do not design or manufacture toys, and
- we are not (and do not claim to be in any way) and we cannot and do not in any case (and do not claim to be in any way) certified or particularly qualified to undertake safety testing or quality assurance activities regarding any toy on your behalf or on behalf of any other person or entity.
Therefore, to the fullest extent permitted by applicable law, you acknowledge and agree that we do not control, are not responsible or liable for, and do not make or give any representation, warranty, guarantee, or indemnity regarding :
- the quality, safety, fitness for purpose, merchantability, or suitability for a particular use concerning any toy,
- the truth or accuracy of any advertising, promotional material, or other statement provided by manufacturers and/or distributors of toys, or
- whether any particular toy will meet the specific needs or expectations of a particular child or other user of our Services. The availability of any Toy on or through our Services does not imply our endorsement of the Toy for the unique needs or expectations of a particular child or other user of our Services.
Any testimonials or reviews of Toys or otherwise involving our Services are solely the opinions and views of the individuals who post or provide them, and no testimonial or review contains or reflects our opinions or views or deemed to be true.
